Notice To Stakeholders On Intention To Review The Local Voice Mobile Termination Rate And Fixed Termination Rate Using Benchmarking Methodology.

The Communications Authority of Kenya (CA) is the regulatory authority for the ICT industry in Kenya with responsibilities in telecommunications, e-commerce, broadcasting and postal/courier services. CA is also responsible for managing the country’s numbering and frequency spectrum resources, administering the Universal Service Fund (USF) as well as safeguarding the interests of users of ICT services.

The Authority in 2010 issued a determination to all mobile and fixed telecommunication service providers (Determination No.2 of 2010), which stipulated the glide path guiding on gradual reduction of the interconnection rates over a four-year period.

The Authority however, froze the implementation of mobile and fixed termination rates for year 2010/2011 for a further one year so as to evaluate the impact of the reduced rates, following concerns raised by some industry stakeholders. Consequently, on 8th June 2011, the Authority issued Addendum No.2 to the Determination No.2 of 2010 revising the mobile and fixed termination rates, implying that implementation would run till 30th June 2015.

Upon expiry of the glide path in 2015, the Authority took a decision to observe the market and see how the market reacts before proceeding to undertake another costing study. Currently, all the telecommunications service providers are implementing a mobile and fixed voice termination rate (MTR and FTR) of KES 0.99.

Owing to the passage of time, changes in the market as well as macroeconomic environment, the Authority now wishes to carry out a review of the telecommunications interconnection rates using Benchmarking methodology.

You are hereby invited to make your submission to on the proposed methodology and any other information that may be taken into consideration in this exercise.

Any person, company or body of persons who wishes to make any representation on or objection to the proposed review must do so via email- addressed to The Director-General, Communications Authority of Kenya. The Submissions should be made within two weeks from the date of publication of this notice.
